DMCA Takedown Notice Requirements

Good Faith Belief

Accuracy Statement
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Processing Time
We typically respond to valid DMCA notices within 2-5 business days. Upon receiving a valid notice, we will remove or disable access to the allegedly infringing material.
3. Counter-Notification Procedure
If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification.
Counter-Notice Requirements
To be effective, your counter-notification must be a written communication that includes the following:
- Your physical or electronic signature
- Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification under DMCA 512 subsection (c)(1)(c) or an agent of such person

4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, SmartToolzy has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

- We reserve the right to terminate accounts for a single severe infringement
- We maintain records of DMCA notices for repeat infringer identification
- Termination decisions are made at our sole discretion
5. Service Provider Status
SmartToolzy is a service provider as defined in the DMCA. We provide automated file conversion tools and do not actively monitor user-uploaded content.
Our Role
- We act as an intermediary for file processing
- We do not permanently host or store user content
- All uploaded files are automatically deleted within 1 hour
- We respond expeditiously to valid DMCA notices
- We designate a copyright agent to receive DMCA notices
6. False Claims
Please note that under 17 U.S.C. ยง 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.
Consequences of False Claims
Filing a false DMCA claim may result in:
- Legal liability for damages
- Court costs and attorney fees
- Potential criminal penalties for perjury
- Loss of credibility with service providers
